General Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions of Sale (hereinafter the “GTCS”) govern the relationship between Maratech AG, a limited company (Société anonyme) with capital of CHF 100,000, registered under number CH-020.3.916.533-7, whose registered office is located at Talstrasse 20, 8001 Zürich, Switzerland (hereinafter the “Seller”), and any person wishing to acquire the products presented on the Aerokultur website, accessible at https://aerokultur.com (hereinafter the “Client”).

The Aerokultur website presents the Seller’s business and allows visitors to submit a contact request or a pre-order for the offers described below. Orders and pre-orders are concluded following an exchange with the Seller, under terms (price, payment methods, delivery and payment conditions) communicated separately to the Client during that exchange. The website does not include an online payment system: placing an order on the website constitutes a purchase request, which only becomes firm and final after confirmation by the Seller under the terms then agreed.

2. Products

The products offered are soilless growing solutions (aeroponic and hydroponic) intended for domestic self-production of vegetables, salads and herbs:

• The stand-alone hydroponic cabinet: an automated solution that can be used without a garden (balcony, living room or indoors). The Client is invited to consult the technical data sheet for detailed specifications (footprint, weight, required power supply, power consumption, noise level).
• The Self-Contained Greenhouse (Serre Autonome): galvanized steel frame, polycarbonate of choice (4 to 16 mm), width 3 m, length from 4 m to 12 m in increments of 2 m, height 215 cm, doors included. Foundation not mandatory but recommended. 5-year warranty on the frame and 10-year warranty on the polycarbonate.
• The pre-order offer (complete pack): an 18 m² greenhouse (3 x 6 m) equipped with 3 vertical aeroponic towers and a hydroponic cabinet.

The photographs, illustrations and descriptions presented on the website are indicative only and shall not bind the Seller beyond the characteristics confirmed in the contractual document provided to the Client.

3. Orders

The ordering process proceeds as follows:

• The Client submits a contact request or a pre-order request on the website via the dedicated form.
• The Seller contacts the Client back in order to clarify their needs and to communicate the terms of the sale: price, payment terms, delivery or installation timescales and conditions.
• The order only becomes final after the Client has accepted these terms and the Seller has confirmed, in accordance with the terms communicated at that time.

Any order implies full and unconditional acceptance of these GTCS and of the specific conditions communicated during the exchange.

4. Prices

Product prices are communicated to the Client during the commercial exchange preceding confirmation of the order. 5. Payment

The accepted payment methods and any instalment arrangements (in particular for the pre-order offer) are communicated to the Client at the time of confirmation of the order: [To be completed: payment methods and terms].

6. Delivery and installation

Delivery timescales and arrangements, as well as any conditions for installation of the greenhouse or commissioning of the hydroponic cabinet, are communicated to the Client upon confirmation of the order: [To be completed: delivery / installation timescales and arrangements].

The Client is responsible for verifying the compatibility of the intended location (dimensions, ground, power supply) with the characteristics of the products, as indicated in the technical data sheet.

7. Right of withdrawal

8. Warranties

• The Self-Contained Greenhouse (Serre Autonome) benefits from a warranty of 5 years on the galvanized steel frame and 10 years on the polycarbonate.

The warranties are exercised under the terms communicated to the Client at the time of sale. They do not cover damage resulting from non-compliant installation, unsuitable use, negligence or lack of maintenance.

The statutory warranties applicable to sales of goods, where applicable, apply in addition to and without prejudice to the commercial warranties set out above.

9. Liability

The Seller shall not be held liable for damage resulting from improper use of the products, failure to comply with the instructions and guidelines provided, or a case of force majeure within the meaning of Swiss law.

The information presented on the website (in particular the advertised performance figures for the aeroponic tower and the greenhouse) is provided for indicative purposes only and does not constitute a contractual guarantee beyond the characteristics confirmed in the sales document.

10. Personal data

Personal data collected via the website (in particular via the contact form and pre-order requests, the sending of e-mails for which is provided by the Resend service) is processed in accordance with the Privacy Policy, which describes the purposes, legal bases, retention period and the Client’s rights. Processing is subject to Swiss law, in particular the Federal Act on Data Protection (FADP/LPD).

11. Governing law and disputes

These GTCS are governed by Swiss law. Any dispute relating to their interpretation or performance shall fall within the jurisdiction of the courts of [To be completed: legally applicable jurisdiction], subject to any mandatory consumer protection rules that may apply.
